This website (“Site”) is operated by OmniPay, the trading name of OmniPay Ltd, a company registered in England and Wales under number 13225781, whose registered office is at S16 Genesis, Innovation Way, Stoke-on-Trent, ST6 4BF.

Personal Data

This document refers to personal data, which is defined as information concerning any living person (a natural person who hereafter will be called the "Data Subject") which is not already in the public domain. Omnipay Ltd is the data “Controller”, as defined in the UK GDPR. This means that we are responsible for deciding how we hold and use Personal data about you. We are required under the Data Protection Legislation to notify you of the information contained in this privacy notice.

The Data Protection Act 2018 (“DPA”), the Privacy and Electronic Communications Regulations 2003 (“PECR”) and the General Data Protection Regulation 2016/679 (“GDPR”), which is EU-wide and far more extensive, seek to protect and enhance the rights of data subjects. These rights cover the safeguarding of personal data, protection against the unlawful processing of personal data and the unrestricted movement of personal data within the EU. It should be noted that the DPA or the GDPR does not apply to information already available in the public domain, such as UK Companies House information.

OmniPay uses the information collected from you to provide services and marketing information that OmniPay believes may be of interest to you and your business. In having made your initial contact with OmniPay, you consent to OmniPay maintaining a marketing communication with you until either you opt out (which you can do at any stage), or we decide to discontinue promoting our services. OmniPay also acts on behalf of its clients in the capacity of data processor. When working exclusively as a data processor, OmniPay will be acting on the instruction of its client and will aim to ensure that the client is fully GDPR compliant.


Some personal data may be collected about you from forms and surveys that you complete; from records of our correspondence and phone calls; and from details of your visits to our website, including but not limited to personally identifying information such as Internet Protocol (IP) addresses. OmniPay may from time to time use such information to identify its visitors. OmniPay may also collect statistics about the behaviour of visitors to its website along with transaction information collected in the process of performing its business.


OmniPay will only collect the information needed so that it can provide you with its services. OmniPay does not sell or broker your data, although coincidentally there may be times when your information could be contained in data that OmniPay has purchased from a third-party list broker, on behalf of a client.

    What Data Do We Collect?

    A separate contractual relationship will be created between you and the payment processor on their terms and conditions, we cannot be held liable for any errors, actions, omissions, or incorrect charges that may be made by them. OmniPay does not retain any payment details, such as billing information or credit or debit card information and we have no access to this data.


    How Do We Use Your Data?

    All personal data is processed and stored securely, for no longer than is necessary in light of the reason(s) for which it was first collected. We will comply with our obligations and safeguard your rights under the DPA and the GDPR at all times. For more details on security see the section below.


    Our use of your personal data will always have a lawful basis, either because it is necessary for our performance of a contract with you (e.g. by placing an order with us), because you have consented to our use of your personal data (e.g. by subscribing to SMS and emails), or because it is in our legitimate interests. Retention policy


OmniPay will process personal data during the duration of any contract and will continue to store only the personal data needed for seven years after the contract has expired to meet any legal obligations. After seven years any personal data not needed will be deleted.


Data storage


Data is held on multiple servers within the United Kingdom. OmniPay does not store personal data outside the EEA.


Changes to Our Policy


We may change this Policy from time to time (for example, if the law changes). Any changes will be immediately posted on our Site, and you will be deemed to have accepted the terms of this Policy on your first use of our Site following the alterations.
